The agreement between you and The Health Almanac when you use our site, our newsletters, or our personalized editions.
PLEASE READ CAREFULLY: These Terms contain a binding arbitration provision and a class action waiver that affect your legal rights, including your right to bring a lawsuit in court or participate in a class action.
These Terms of Use ("Terms") govern your access to and use of thehealthalmanac.com, the personalized Living Almanac, our SMS and email editions, and any other services we offer (collectively, the "Services"). By using the Services you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
Eligibility
You must be at least 18 years old (or the age of majority where you live) to create an account, subscribe to the SMS edition, or complete the Health Almanac snapshot. By using the Services you represent that you meet this requirement.
Not medical, legal, or financial advice
The Services publish general-audience journalism and educational content. Nothing on the Services is medical, legal, tax, or financial advice, and using the Services does not create a doctor-patient, attorney-client, or other professional relationship. See our medical disclaimer for details. Always consult a qualified professional for your specific circumstances.
Your account and messages
- You are responsible for the information you provide (including your phone number and any assessment answers) and for keeping your access credentials secure.
- By subscribing you consent to receive recurring SMS editions and transactional messages. Message and data rates may apply. Reply STOP to unsubscribe and HELP for assistance.
- You may unsubscribe at any time from the My Health Almanac dashboard.
Acceptable use
You agree not to:
- Access the Services by any automated means, including scraping, except as our robots.txt allows.
- Interfere with security, rate limits, or the integrity of the Services.
- Post or transmit unlawful, misleading, defamatory, or infringing content.
- Attempt to identify other readers or reverse-engineer personalization.
- Use the Services to build or train a competing product without our written permission.
Intellectual property
All content published on the Services — articles, editions, imagery, typography, source code, and design — is owned by The Health Almanac or our licensors and is protected by copyright and other laws. You may view, print, and share links to our content for personal, non-commercial use. Any other use — including republication, translation, or incorporation into another product — requires prior written permission.
Feedback
If you send us feedback, suggestions, or corrections, you grant us a perpetual, royalty-free license to use them to improve the Services without obligation to you.
Third-party links and services
The Services may link to third-party sites, tools, or advertisements. We are not responsible for third-party content, products, or policies. Your use of a third-party service is subject to that service's own terms and privacy policy.
Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTENT WILL BE ACCURATE OR COMPLETE FOR YOUR PURPOSES.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE HEALTH ALMANAC AND ITS CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
Indemnification
You agree to indemnify and hold The Health Almanac harmless from claims arising out of your misuse of the Services or violation of these Terms.
Changes to the Services and these Terms
We may add, change, or discontinue features at any time. We may also update these Terms; material changes will be announced on this page with a revised "last updated" date. Continued use after a change constitutes acceptance.
Binding arbitration
Any dispute, claim, or controversy arising out of or relating to the Services or these Terms — including their formation, interpretation, breach, or termination — will be resolved by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration will be seated in the state in which the Publication maintains its principal editorial office, and the Federal Arbitration Act governs the interpretation and enforcement of this provision.
Small-claims carve-out. Either party may bring an individual action in small-claims court for disputes within that court's jurisdiction in lieu of arbitration.
30-day opt-out. You may opt out of this arbitration provision by sending written notice through the contact page within 30 days of first accepting these Terms. Your notice must include your name, the phone number or email associated with your account, and a clear statement that you decline arbitration. Opting out will not affect any other part of these Terms.
Class action waiver
You and The Health Almanac agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, representative, or private-attorney-general proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. You and The Health Almanac each waive any right to a jury trial.
If this class action waiver is found to be unenforceable as to a particular claim, then that claim (and only that claim) will be severed from the arbitration and may proceed in court; the remainder of the arbitration provision will remain in full force and effect.
Governing law and disputes
These Terms are governed by the laws of the United States and the state in which the Publication maintains its principal editorial office, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in that state.
